Digital Music Downloads in Canada - Special Rules?




Okay... or, Ok-eh!! Are there any special rules regarding digital music downloads in Canada?

Well, there are a few sites in Canada - including a new one that commenced service this month - that offer paid music downloads specifically for Canadian residents.

It is important to realize, however, that the Canadian rules regarding downloading music are a bit more lax than they are for their American neighbors (oops...neighbours).

Specifically, it is currently not against the law in Canada to download music without the artist's or label's consent. This law applies to any resident in Canada where the downloads are made in Canada.

The law does not apply for Canadian citizens who download abroad.

In spite of this, canlii.org believes that downloading is illegal. However, no official stance has been interpreted in court. So, technically it is official at present.
